Terms of Service & Conditions

1. Acceptance of Terms & Contracting Entity

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client", "Contractor") and F&K Estimations LLC, doing business as PlumbingEstimatingServices.org ("Company", "we", "us"). By requesting a cost estimate, uploading architectural drawings, or purchasing a quantity takeoff package, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

2. Scope of Estimating & Quantity Takeoff Services

PlumbingEstimatingServices.org provides independent third-party quantity takeoff (QTO) services, CSI Division 22 material itemization, and MCAA labor hour productivity modeling. Our deliverables include:

• Itemized bills of materials (linear footage of piping, fitting allowances, valves, fixtures, and specialty equipment).
• Color-coded vector PDF blueprint markups created via digital estimating software (Bluebeam Revu / FastPIPE).
• MCAA-calibrated baseline installation labor hours broken down by system.
• Customizable Excel spreadsheets ready for contractor margin, tax, and quote insertion.

3. Contractor Responsibilities & Local Code Compliance

Crucial Notice for All Bidding Contractors: Our estimates are prepared strictly based on the design drawings and project specifications provided at the time of quotation.

• The bidding contractor remains solely responsible for verifying site-specific conditions, local Authority Having Jurisdiction (AHJ) code amendments (such as local modifications to the UPC or IPC), collective bargaining union labor rates, and final tender prices submitted to General Contractors or project owners.
• We do not provide licensed Professional Engineering (PE) structural calculations or certified mechanical stamped drawings. Our work represents quantity survey consulting and cost modeling.

4. Turnaround Times, Revisions & Addenda

Standard turnaround is 24 to 48 business hours depending on project square footage and drawing complexity. Pre-bid addenda or scope clarifications issued by architects before the bid deadline will be incorporated promptly. Minor scope revisions within 7 days of delivery are included at no additional charge. Significant drawing redesigns or subsequent bid re-issues after delivery may be subject to a nominal revision fee.

5. Intellectual Property & Deliverable Rights

Upon receipt of full payment, the client is granted an irrevocable, non-exclusive license to utilize all generated spreadsheets, markup drawings, and takeoff documents for bidding, procurement, and project execution purposes. We do not reuse your specific project takeoff files for competing tenders.

6. Limitation of Liability

To the fullest extent permitted by applicable law, F&K Estimations LLC and PlumbingEstimatingServices.org shall not be liable for any indirect, incidental, punitive, or consequential damages, including loss of profits, lost bidding tenders, liquidated damages, or jobsite delays resulting from the use of our takeoff estimates. Our maximum cumulative liability arising from any estimating engagement shall not exceed the total fees paid by the client for the specific takeoff service at issue.

7. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, United States, without regard to its conflict of law principles. Any legal actions or disputes arising under these Terms shall be resolved in state or federal courts located in Marion County, Indiana.
